These terms apply to your use of this website and your purchases from X SPORTS&LIVING PTY LTD (ABN 21 678 776 755), trading as X sports & Living. By placing an order you agree to these terms.

Your consumer rights

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. See our Returns & Refunds and Warranty pages.

Products and pricing

• All prices are in Australian dollars (AUD) and include GST where applicable.
• Product images, colours and descriptions are as accurate as possible, but minor variations may occur between screens and actual products.
• We may correct pricing or description errors. If we do, we will contact you and give you the option to proceed at the correct price or cancel for a full refund.

Orders and payment

• An order is accepted when we confirm it by email. We may decline or cancel an order, for example if stock is unavailable, and will refund any payment made.
• Online payments are processed securely by Stripe. Other payment options, where offered, are shown at checkout and may have additional conditions.
• Ownership of goods passes to you once full payment is received and the goods are delivered or collected.
• Afterpay and Zip are provided by those companies and are subject to their approval and terms. We do not provide credit.

Delivery, returns and warranty

Delivery, returns and warranty are covered by our Shipping & Delivery, Returns & Refunds and Warranty policies, which form part of these terms.

Installation

If you choose installation, you must provide safe and reasonable access and a suitable, level space. Additional charges may apply if the site is not suitable, and we will tell you before proceeding.

Use of this website

Website content, including text, images and logos, belongs to us or our suppliers and may not be copied or reused without permission.

Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss arising from your use of this website or our products. Where the law allows us to limit our liability for a breach of a consumer guarantee, our liability is limited to resupplying the goods or paying the cost of resupply or repair.

Governing law

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction.
